What personal information is being gathered by Smarterwork and how is this information being used?

User registration data and User background data
The information you give Smarterwork by registering as a User, to post a Project or to make a bid for a Project includes information such as your full name and address, other contact details, Tax/VAT identification number, user name, password and password validation. In addition to the information you provide to us, Smarterwork may also receive information about you from other sources and add such information to your account (such as address details), so as to make your User details as accurate and up-to-date as possible. This information is collected for several purposes including the following: (i) personal identification; (ii) to complete the profile of Experts and Clients; (iii) to allow us to contact you in relation to the management of your Project and/or customer care, if necessary; (iv) to customize the content of our site to meet your specific needs; and (v) to make product improvements to Smarterwork; and (vi) for VAT/sales tax, invoicing/billing and secure transfer of Project monies. In addition, your e-mail address is collected to send you an e-mail message confirming your new User registration, for sending messages when managing Projects online and for sending you Smarterwork newsletters.

Online surveys
Smarterwork values opinions and comments from Users, so we may conduct online surveys. These surveys are optional for all Users. Typically, the information is aggregated and used to make improvements to Smarterwork and to develop appealing content, features and promotions for Users. Survey participants are anonymous unless otherwise stated in the survey.

Cookies
Cookies are small pieces of information that are stored by your browser on your computer's hard drive. Smarterwork uses cookies in several ways. We use cookies to allow you to Sign in without having to type your User name each time. Instead, only your Password is needed to access the system. We also use cookies to track usage of the project management modules and to serve advertisements through our advertising networks. Most Web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future.

IP Addresses
Smarterwork collects IP addresses to help diagnose problems with our servers and for system administration. These addresses shall only be used for technical purposes by Smarterwork.

Who will the information be shared with?

Smarterwork may share User information in the following situations:

Within the Smarterwork group of companies
Smarterwork has operations in several countries. User information may be transferred between the different companies that Smarterwork control, whenever necessary for the purposes of business conducted on the site. By using the site you agree that your personal information can be transferred within the Smarterwork group in this manner, and that this may involve transfers outside the European Economic Area, e.g. to Smarterwork in the United States of America. Smarterwork will take all reasonable steps to ensure that your information is handled in accordance with its Privacy Policy by all the companies within the Smarterwork group.

Between Users
When you do Projects through Smarterwork, we provide information about you to Experts/Clients or other parties that may be involved (e.g., a Moderator) to ensure the successful fulfilment of the Project. In relation to the Profile completed by Experts, the information contained therein shall be made available to Clients in order that they can decide whether to choose a particular Expert for their Project and enter into the contractual relationship with such Expert.

If you as a User wish to be certified as an Expert in a particular service category, you need to complete either an online test or an online application form, depending on the category in which you wish to be certified. The information you provide for the purposes of certification is regarded as confidential by Smarterwork and shall be used by the respective Smarterwork Category Manager solely for the purposes of certification.

Affiliates
If Smarterwork should in the future choose to work with affiliate businesses whereby such affiliates are to provide services or products to Smarterwork's Users, then Smarterwork may share User information with such affiliates in relation to such transactions.

Transfers of assets
Smarterwork may in the future be subject to business acquisitions. In such circumstances, User information related to the acquired business will form part of the assets that are being transferred to the acquirer.

Agents
Occasionally, Smarterwork may hire a third party to act on our behalf for different projects, such as market research surveys and contest entry processing. In such circumstances Smarterwork will provide User information to these third parties specifically for use in connection with these projects. The information we provide to such third parties shall be protected by a confidentiality agreement and is to be used solely for completing the specific project.

Otherwise required
In addition to the circumstances described above, Smarterwork may disclose User information if required to do so by law, court order, as requested by other government or law enforcement authority, or in the good faith belief that disclosure is otherwise necessary or advisable including, without limitation, to protect the rights or properties of Smarterwork or when we have reason to believe that disclosing the information is necessary to identify, contact or bring legal action against someone who may be causing interference with our rights or properties, whether intentionally or otherwise, or when anyone else could be harmed by such activities.

Opt-out policy

As a User you will occasionally receive e-mail newsletters from us about special offers, new Smarterwork services and other noteworthy news items. We hope you will find these newsletters interesting and informative. Of course, if you would rather not receive them, you can choose for the opt-out option on your Personalise/My Details page by clicking onto the option entitled Change Email Preferences.

How can you access, update or correct your information?

At any time, you can view update and/or correct any of the data that you have submitted to us, including your User registration data and (where applicable) your personal Profile. In order to access such information, click onto the appropriate link within the My Office area of the site. In respect of the categories which require certification by application form, e.g. Legal, Tax, Business Consulting, Translation etc., you can always access and amend (where necessary) the information submitted by logging onto the site and re-qualifying into that particular service category.

What safeguards are in place to protect your information?

As required by applicable data protection legislation, Smarterwork follow adequate security procedures and take appropriate measures to ensure that the information about you is not damaged or destroyed, or accidentally disclosed to a third party and to prevent unauthorized access to it. This means that we may require you to co-operate with our security checks before we can disclose information to you.

All financial information that you provide to Smarterwork is transmitted using DES encryption. In relation to all other personal data submitted by you to Smarterwork it is important that you protect and secure you username and password from any unauthorized use. As stated in the User Agreement, you are responsible for all use of this site using your username and password.

How do you know that your payment information is secure?

Smarterwork is an official Verisign Secure Site. This means that all information sent to this site, if in an SSL (Secure Socket Layers) session, is encrypted, protecting against disclosure to third parties. To learn more about our security certification, click on the Verisign icon on this page.

What other information should I know about my privacy?

Smarterwork contains links to other Web sites. Please note that when you click on one of these links, you are entering another Web site for which Smarterwork has no responsibility. We encourage you to read the privacy statements of all such sites as their policies may be materially different from Smarterwork's Privacy Policy. Of course, you are solely responsible for maintaining the secrecy of your passwords and any account information. Please be very careful, responsible, and alert with this information, especially when you are online.

Any material changes in the way Smarterwork uses personal information will be described in future versions of this Privacy Policy, in order that Smarterwork users are always made aware of the Privacy Policy in effect at the time of use. You should check our Web site frequently to be aware of the most recent version.
